This morning Williams launched a new website to put information out to the public on what it's operational intentions and plans are. I don't know how else to reach Mr. Smith, Mr. Cummings and the other Flower Mound land owners who have allowed the drillers onto their lands, so I'm coming to Shiloh Chris' blog.
I urge you to watch this video and, instead of picking apart every little detail that isn't exactly like your specific situation, just listen to Mr. Zimmerman. He's a landowner just like you who I bet, until yesterday, was singing from the drillers' hymnal about how safe, clean and proven the drilling process is.
But today, he's being interviewed on television, saying that his community has been devastated and his property destroyed. My guess is he's doing a lot of crying tonight, and will be begging forgiveness from his neighbors for what he allowed to happen on his property.
I have no interest in watching any of you on local DFW news telling us how sorry you are for devastating Flower Mound and destroying your beautiful properties. And believe it or not, I have no desire to say "I told you so."
I know you won't listen to me. Will you listen to your counterpart in Pennsylvania? Trust me...there will be no forgiveness for you if this happens on your property, because you have been warned. Repeatedly.

Are you really so greedy that you would risk a similar fate in your community?
Come on, Ladd, think this through. The mineral owners you referenced have already leased their mineral rights and the drilling companies are complying with their lease obligations by drilling on the property and extracting the gas. So what would be the point of them listening to this ONE mineral owner in Pennsylvania (out of hundreds of thousands if not millions all over the country) that is having seller's remorse?
I gave you the solution to this messy situation in a different post, Ladd. Just get together with your anti-drilling chums, incorporate, and buy the leases and the mineral rights from the drillers and land owners. We get our economic value out of our minerals that we acquired with our property purchases and you guys get to feel good about yourselves. Good deal for everyone.
What kind of liability insurance do mineral rights owners and operators have to cover the losses to others when accidents like these happen?
Would the operator and land owner be legally liable for damages both physical and lost property values?
I can't imagine residents of Flower Mound sitting idle if something like this happens in our town.
My sense is that a class-action suite would be brought upon the operator & land owner should we have an incident like this happen in Flower Mound. Especially when our requests for increased safety measures and objections to a CCF go ignored.
TRob, The Town of Flower Mound requires the operator as part of the permit to maintain a liability insurance policy to ensure that property owners would be protected. The lease holders are indemnified by the operator thru their lease contracts.
I would imagine that if something were to happen that the operator would be liable for actual damages, lost property value is a subjective thing. If say the damage rendered your property unusable for habitation for example, then of course there would be a loss worthy of consideration. However; if the damage to your property was repairable, you would have to consider how many people sold there home prior to, and directly after the incident to come up with a figure of loss, and apply other factors like the appraisal district amount, etc....
Thanks, Anonymous, for reinforcing what I already feared was true: It's ALL about the money to you. You don't care about potential harm to your neighbors, you don't even care about potential risk to your own property. Just "show me the money!"
You and your like-minded friends are why we are so dedicated to our fight. We will protect our rights and even protect you from yourself in the process of upgrading our ordinances and reducing the drillers' impact on our town.

Excellent, Ladd, finally an intelligent observation on your part! Yes, it is all about the money. That is why we leased our mineral rights to the drillers - to make money. I have to say that I am a little disappointed that it took you this long to figure that out.
The reasons it's "all about the money" is that we do not accept that gas drilling involves any more material health risks than those posed by a gas station or even by driving gas-burning vehicles. Would you suggest a moratorium on these activities while we study them some more?
Now here is some news for you Ladd, which you may not like. It's also "all about the money" for many of your anti-drilling chums. I'm not referring to the loons that think they will contract cancer if they inhale within a mile of a drilling rig, I'm talking about residents that are much more concerned about their property values deteriorating than any health risks. And I understand their concern - it's the same one I had as I watched so many developments spring up in eastern FM over the years, no doubt damaging the value of my property in western FM. But frankly, they (and you) have no business in my business.
I think that the FM Scares and the rest of the community (mineral rights owners included) are not so far apart on the issues.
Mr. Biro, you are hurting your cause. "You and your like-minded friends" and such. And I am so TIRED of you not having any original thoughts and constantly trying to turn someone's arguement around with the phrase "thanks for reinforcing my point" when really they havent.
It is your self-righteous and combative style that make you no better than a playground bully and turn so many off to the position of Flower Mound Scares.

Didn't Steve Lyda say last night at the Town Council meeting regarding Williams....and I quote..."any business this company has in Flower Mound should be between the gas company and it's lease holders and comply to the ordinances of our town"....
Of course, a big pause followed as he (Lyda) realized what he said. Hmmmmmm......can't have it both ways Lyda!
It also would be nice if Lyda could actually speak to the residents of FM without having a prepared speech in front of him. He is a terrible speaker!
I watched the videotape of the public participation section of the meeting. That Lyda pregnant pause was hilarious!
An thank you, Chris, for raising the issue of the idiotic pipeline dispute with Mockingbird (what a waste of our tax dollars). Did the Council address that issue later in the meeting?
No unfortunately they did not. Mr. John Todd also raised the issue of the lawsuit as well, and when Terry was asked by council to give him an answer, Terry said that he would get with him at the break. Mr. Todd then said he wanted it on the record, but Terry refused. Later during the break, I am not sure what was said, but Mr. Todd, Tom Hayden, and Terry were having a pretty heated discussion about it.
Sounds like a sensitive issue with Mr. Terry. Good. I'll try to make the next meeting and make the same inquiry. Perhaps if several of us ask for the same information the Council will urge hime to be more forthcoming.
I see the misinformation and slander campaign is alive and well in Shiloh land.

On another topic, did you hear the good news that Williams/Mockingbird has filed a motion to dismiss in the idiotic pipeline case? Hopefully their action will force a quicker death to this inane legal venture by the Council Clowns - Filidoro and Hayden.
